The fact that I got permanently banned is ridiculous. My first "warning" was for xraying, but I thought we went over this. Like 6 years ago some random dude in my village was hacking and he gave me a ton of diamonds because of it. Not knowing that he was hacking, I took the diamonds and left. When I logged back on I was in jail with a warning for hacking. This was ages ago and I explained exactly what I just explained at the time.

The main reason I got banned is because of "harassment". Whenever OctoGamer and I happen to be online at the same time (which is almost never), my friend and I have this little joke where we immaturely say stuff in chat like, "yo octo mad gay" and "yo fuck that octo dude". Octo has said that we have been doing this for years, which is a huge stretch. We have done this like 3 times over that past 2 or years. This is not true harassment. I never intended to seriously inconvenience Octo and I never intended to cause him serious problems. The day I got banned was the first time that Octo has stressed to me that this upsets him and that he is seriously bothered by it. If Octo told me a long time ago that what I consider to be a harmless troll was seriously upsetting him then I would have stopped, but he never did. I don't consider immaturely saying "hey octo you mad gay" to be bullying or harassment. It is just a harmless troll.

Additionally, I was never notified of the warnings that Octo brought up the day I was banned. I don't ever recall formally receiving any warnings for harassment, if I knew there was a chance of me getting banned if I were to continue those actions, I would have stopped. You can not give someone a warning, not even tell them, and then bring up those warnings when deciding to ban them.

I'm not denying that I don't deserve any kind of punishment, and I will definitely tone down what I say in chat if I get unbanned. However, getting permanently banned for saying "yo octo is gay" on a server prides itself on having FREE SPEECH is absolutely absurd. He could temporarily mute me or easily do /ignore. I hold no actual hatred towards anyone on the server and I obviously don't mean anything I say. When I said, "consistency is the key" it was a simple joke/troll. I am more than willing to talk to Octo and work something out.

Yeah, you've got X-ray, harassments warning, harasment ban before this one off the top of my head. none of the other staff seemed opposed to what I was saying, and you pretty much summed up the story well for me here so I don't have to retype it again.

I will go back into the logs and find the village I protected the same week this started happening because I remember throwing up houses when I was building up an underground base just to protect it to get you out of my land.

the server does pride itself on freedom of speech but this isn't really a freedom of speech matter if you really think about the issue I addressed to you here and on the server.
and you saying "I'm butthurt" and "I'm mad" and "I'm gonna cry about it" (paraphrasing) really doesn't help your "its a joke" infact those comments lean me even more towards the bullying side, which again, it didn't offend me - this has just been going on for years and i'm sick of it. As octo said most of the staff seemed to be okay with the punishment so I wish you luck on the appeal.

Here is a link to all of the times that Shazam has called Octo gay within the past two or so years. I got those from the discord message log, unfortunately I dont have access to the real logs so I cant find evidence of it being a more long term thing or not. Is it possible for the dates for the previous harassment ban and warnings to be found? Those might be relevant.

As far as the nuances and whether that constitutes harassments, I have no idea and It's not my place to say anything about it. However, I think it may have been a better idea to give Shazam an official warning instead of saying "stop" twice, then perma-banning him. Shazam is a pretty long term player iirc, I think that especially in those cases, the people enforcing those rules should try to remain professional; even if they're annoyed. In addition, this whole conflict probably would have never gotten to this point with an official warning. Shazam stated that he would have stopped had Octo been more clear about him being banned if he continued. A more professional attitude towards these types of things would most likely save everyone time.

I encourage you to go look into the logs because we have only done this to you a few times. This is not something that has been going on for years. I would not consider what you quoted true harassment. I would prefer to talk to another staff member about this because you seem very emotional. All of what you are saying is a stretch. If you actually read the appeal I gave an explanation of the xray warning. Additionally, like I said in the appeal, today is the first time you have ever stressed to me that this upsets you and that you would like me to stop. I understand that what I said actually upset you and I'm sorry for that. I'll take a mute, but a permanent ban seems very excessive. I misunderstood the rules and did not know when I was breaking them. Again, I would prefer to discuss this with another staff member who won't take this personally.

You've requested evidence via logs, which is your right, so you will get them. However, it's late and my head hurts so I'll post them tomorrow if someone doesn't beat me to it.

I'll say this based on my reading of the logs:
I can't find evidence supporting a harassment case against you. I may need to double check the logs, but I can't find much to convince me. You certainly may be bugging Octo with saying "octo gay" a few times or whatever, but I'm having a really hard time agreeing with a permanent ban. The logs will help clear this up.

I wish this was sorted out privately.

I'm just a supporting friend for JoelEmbiid. So since Octo has been insisting that my friend has been calling him "gay" for "years" I would love to see evidence that suggests this. From what I can tell, he said "Octo mad gay" on 5 separate days in the past year. This hardly seems like every single time we are on together (as he mentions it becomes clockwork to him in his argument). Octo insists "years, yes years", yet I see no proof, and he has nobody to support his accusations of JoelEmbiid calling him "mad gay" for so long. In addition to this, JoelEmbiid was 12 years old when the x-raying incident happened, and he had absolutely no idea what an appeal was, and that it could save himself from getting permanently banned in his future, so it seems a little unfair to hold that against him now (and for something as small as "Octo mad gay"). Octo repeatedly brought this up in my exchange as some sort of justification for his action. I would think, and dearly hope, that being a staff member would mean having the maturity to ignore trolls such as JoelEmbiid, or at least the maturity to respectfully explain that what my friend was doing has been offending, and truly bothering him. Yet not once did this happen. Just a couple of “stops” and a ban! Could you imagine what would happen if all staff members reacted to people who said things that could MAYBE be considered as harassment did what Octo did? The server would be dead.

This was when Octo gave no official warning before the ban, and once Brutal asked why he was getting banned, Octo replied with "cus ur bein a cock bro" (an intellectual, and insightful response from a staff member!). There seems to be a repeating pattern with Octo taking things personal and banning people for little reason and without warning.

Octo also says in his argument “you guys all take ‘having a record’ on a minecraft server far to seriously…” I find this quite problematic, as one of the main reasons Octo had decided to ban RealJoelEmbiid was because of his record from literally years ago, yes, YEARS.

Something doesn’t seem very fair here, and it seems like Octo hasn’t learned much from his past experiences in telling people when they are receiving warnings, and unjustly banning them.

P.S. I got muted in server chat by Octo for trying to explain all of this to him. Once again, there is a clear abuse of power here.

It's not really my place to say, but apparently Shazam has only been actually banned for the harassment, since the x-ray was years ago and I've heard he didn't actually x-ray. In any case I don't think things like these deserve permban, but a temp ban for enough time to realize/understand that what he did was wrong, and to make sure he won't do it again.

I'm not defending what I said in 2015, when I was 12 or 13. I was going through one of those immature phases when I thought that as being edgy and offensive as possible was comedy gold. I deeply apologize for what I said back then and I understand the punishment I received from Noket. While I still think that offensive humor can be funny to a certain extent, the jokes I make now are not nearly as bad. Still, I understand that when I'm online I can take jokes too far, which is something that I should work on. I apologize for what I said to Octo. My intention with the joke was that what I was saying as so stupid and immature he would just laugh it off. I thought that it was a harmless troll, but I didn't know it was something that really upset him. I also misunderstood what constitutes as "harassment" by your standards. On the official rules spread sheet, you state that bullying/harassment is, "Malicious non-consensual intimidation, coercion, or aggression with real-life significance". I don't understand how saying "octo mad gay" is threatening and related to real life.

I still stand by what I said my appeal. I believe that a permanent ban for this is extreme. I never received any official warning that what I was doing could result in a ban. I would understand and accept any other punishment like a mute or a temp ban, but permanently preventing me from playing on the server seems like an unjust punishment. If you were to let me on the server again, I promise to keep to myself and not troll or be toxic in chat. This server is the server that I grew up playing on it would not be ideal for me to lose all the progress I made over the years. Thank you for reading.

i dont see how saying "octo mad gay" is not malicious when its to the extent you've done it over the years, or to other people such as in the noket logs infact. like whats the point dude? to annoy me? to offend someone? again, not offended by being called gay because thats not an insecurity i have about myself unlike some people who throw that word for "trolling purposes" you should have let up years ago when you were first banned for this nonsense. the fact that this was the only way you interacted with me recently is malicious enough for me to consider it harrasment, its annoying persistent harrasment not offensive harrasment. I had said somewhere, can't remember where though, if I saw how you were acting towards me for all these years to another player or staff member or whatever I would have already banned you long ago for it. Harrasment doesn't just have to be offending someone or bullying someone or threatening someone dude.

So although this incident does not directly involve me, I was online when this happened.
First off, I would like to start by saying in regards to this incident, I am commenting my opinion regardless of my personal view of all those involved and commenting.
What Shazam was doing to me does seem like harassment as it was a constant incident (as the logs show). Shazam also showed what seemed to me like a lack of respect or consideration for Octo when it was clear that Octo did not appreciate these messages.
Octo, as staff cannot /ignore a player as it would limit his ability as a staff member to help Shazam if help was needed.
I can also confirm Octo's statement that he did mention he would have punished Shazam by now if it was another staff member that had been the 'victim' to this harassment.
The issue for me is simple, Octo did not follow staff protocol as I am aware of it. There was NO offical warning, via Kick (ideally I would want to see two kicks before action is taking further, as two kicks can clarify it is not a jokey kick incase their was a misunderstanding). While it took Shazam till the 30th to show some sort of genuine remorse, a perm ban is incredibly extreme. I would have suggested -> kick, kick, temp mute, temp ban, ban. I know that this may change per circumstance, but to jump straight to perm ban is extreme.
Due to staff not following protocol by showing clear warnings and by how fast staff were to shut this appeal down, I am disappointed.
Thus, I suggest due to the harassment and staff's mess up, a 2 week temp ban seems roughly fair. But of course staff may want to change this length of time when they compare it to other players would have committed a similar offense in the past and their punishments in the past.

There have been many different ideas and opinions as to what should have happened in this scenario among players and among staff. At first I felt as if the ban was justified and that Shaz should serve his perm ban until his next appeal date, however after looking at logs and getting a better grasp for what happened I feel it is too harsh. The decision below is solely based on #2 of the Speech & Expression section of the VC rules where it states "Not Allowed: - Malicious non-consensual intimidation, coercion, or aggression with real life significance." I cannot find any coercion, aggression with real life significance, or Intimidation. While what Shaz did was obviously very annoying and petty I cannot see being called "gay" a form of harassment that would result in a permanent ban on villagecraft which has a long history of having racial slurs and toxic chat. Shaz has already been banned for 6 going on 7 days I believe and I see that as sufficient enough time served for his actions and I hope he's learned from it.
